In-N-Out Files Lawsuit Against DoorDash; Did The Latter Commit Copyright Infringement?

In-N-Out Burger filed a lawsuit against food delivery service DoorDash.

DoorDash is facing trademark infringement case for using the In-N-Out's logo without the company's permission. In-N-Out is also concerned on how DoorDash delivers their food or for how much time is consumed before it gets to their customers which is important for them, according to TMZ.

The case was filed at the U.S. District Court for the Central District of California on Nov.6 which states that, "despite the fact that DoorDash is in no way affiliated with In-N-Out, DoorDash has advertised, and continues to advertise, that it delivers food from In-N-Out's restaurants," reported Eater.

"Further, In-N-Out has no control over the time it takes DoorDash to deliver In-N-Out's goods to consumers, or over the temperature at which the goods are kept during delivery, nor over the food handling and safety practices of DoorDash's delivery drivers," as the file statement continues.

In-N-Out first contacted DoorDash in April 2014 to put down the logo on their website and to stop delivering their food. In turn, Tony Xu, DoorDash's CEO, removed anything related to In-N-Out from their website, but not for long since in July 2015, they started to deliver In-N-Out burgers and even posted a replica of the company's logo again.

In response to the issue, DoorDash released a statement saying, "DoorDash uses its innovative logistics technology to deliver the very best food and products in neighborhoods across the country," according to TechCrunch.

"While we have various relationships with different merchants, we are proud to help people get their favorite food delivered directly to their door," the representative added.

DoorDash is now worth $600 million, is a third-party delivery service that offers to deliver foods from several restaurants to customers using their website or mobile app. Customers that are residing in New York City are upset because of food overpricing in their website, according to TMZ.
