Actress Scarlett Johansson filed for divorce Tuesday from her estranged husband and French journalist Romain Dauriac. This triggered the start of a public custody battle for their two-year-old daughter Rose Dorothy. The former couple reportedly signed a prenuptial agreement before their secret wedding in September 2014. Scarlett Johansson ended the private divorce negotiations with her former husband when she filed the divorce. Dauriac's lawyer Hal Mayerson told The Associated Press that they didn't expect this move from the other camp and considered it as a "pre-emptive strike" for the child custody. "Mr. Dauriac is tired of having to run his life and his child's life based on Ms. Johansson's shooting schedule," said Mayerson, who called his client the "primary parent." Dauriac wants his daughter to live with him in France while promising Johansson "access to her daughter any time she wants to come to Paris."
A source close to Scarlett Johansson told PEOPLE that the actress' team merely followed the standard legal procedure of a divorce, that "under the law in NYC, the filing of an action for divorce is merely procedural," it's "no big deal" and "not a hostile act." The source said, "While her lawyer did request that Scarlett gets residential custody, again, for procedural purposes, they preserved all rights she had if they didn't resolve the case." Dauriac's lawyer countered that the act of filing for a divorce "is a serious matter in the state of New York, period."
The former couple signed a prenuptial agreement a month before they secretly wed. Mayerson claims the agreement doesn't cover the financial costs over the custody of the estranged couple's daughter.
