Aespa Fans Sue SM Entertainment Over Brazil VIP

A Brazilian aespa fan page announced on Sept. 7 that it is pursuing legal action against SM Entertainment. Its message: "In 2026, we are pursuing legal proceedings against SM. The law works both ways."

The line was a pointed callback. In 2024, SM sued that same fan page, Info Aespa Brazil, after it uploaded aespa's unreleased content "My First Page" to Google Drive. Two years later, the fandom is turning that legal precedent back on the agency.

The dispute traces to aespa's Sept. 4 concert at Mercado Livre Arena Pacaembu in Sao Paulo, the opening show of the South American leg of the group's "SYNK: COMPLæXITY" world tour. The top-tier VIP package, priced at 2,689 reais (about 705,000 won), combined a 990-real Pit admission ticket with a 1,688-real service fee covering priority entry, exclusive merchandise, a photocard set, a VIP lanyard and an invitation to a post-show "send-off" - a K-pop touring staple where top-tier ticket holders get a brief close-up moment with the artists after the main set.

Complaints started the day of the show. Buyers posted on the Brazilian consumer platform Reclame Aqui that the send-off lasted only seconds and that merchandise they'd been told to arrive early to collect never showed up. Info Aespa Brazil escalated to a legal filing three days later, then gave the case a visual argument on Sept. 9: side-by-side footage comparing the Sao Paulo send-off with the one two days later at aespa's Santiago, Chile show, first published by the Brazilian outlet Capricho. In the Chile clips, members stop for photos and autographs. In the Sao Paulo clips, they pass down a fan aisle offering quick greetings.

"We have secured the videos, so we will get our money back," the fan page wrote, adding that buyers "paid a high price for the VIP package but did not receive the benefits we expected."

VIP sticker shock isn't new to K-pop touring - complaints simmer online after almost every stop. What differs here is a fandom moving past complaints and into a paper trail: purchase receipts, the advertised benefits list and now side-by-side video timing. Whether Brazilian consumer law treats a shortened meet-and-greet as a breach of an advertised service, rather than a subjective letdown, is the question a filing would put in front of a judge.

The Sao Paulo show was no minor stop to begin with. Brazilian daily Folha de S. Paulo reported 21,652 tickets sold, making it the second-largest concert by a Korean girl group ever held in Brazil, trailing only TWICE. That scale is part of what's fueling the backlash: fans who paid premium prices for a rare South American date are now comparing notes, city by city, with fans who got more time with the group two countries over.

SM Entertainment has not issued a public response to the refund demands. Info Aespa Brazil says it is continuing to gather video evidence as it prepares its filing.
